Progressive Equine Partnerships maintains this website, any courses offered, directory listings and other linked and related sites (the “Site”) for the use of its customers, members, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and Progressive Equine Partnerships. If you do not agree to these terms, do not use this Site.
Members
1. Fees
Progressive equine partnership fees are non refundable. Considerable time is spent performing due diligence on membership applications. Upon confirmation of becoming a progressive equine professional or establishment member then you acknowledge the following terms.
By registering with progressive equine partnerships and creating an account on the website you represent and warrant that you are lawfully able to enter contracts on behalf of yourself or the company you represent. You are responsible for all activities associated with your account, including any invoices or payments. You must take precautions to prevent any unauthorized use of your account. If you feel somebody has access or unauthorized use of your account, please notify us immediately. Please do not provide your account login to any third-party or allow another person to access your account or the membership area of the site.
2. Cancelation of membership
Members have the right to cancel membership and remove information from the directory at any time. Fees will not be refunded and it is the responsibility of the member to ensure any standing order of payment for subscription is cancelled.
Progressive equine partnerships reserve the right to remove any member found to be in breach of our guiding principles.
3. Use of logo
Approved annual members have permission to proudly use the logo of progressive equine professionals and/or progressive equine establishments on all marketing material. If membership is cancelled by yourself or Progressive equine partnerships use of the logo is no longer permitted and must be removed from all marketing material.
4. Limitation of Liability
Progressive equine partnerships will accept no responsibility for any losses, either direct or indirect, which you suffer in connection with the services provided under this contract.
Students
1. Use of Site
Progressive Equine Partnerships provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”). Progressive Equine Partnerships authorises each User to view and download one copy of the Materials. Materials may be downloaded and a maximum of one copy of the Materials may be printed provided that Users make no modifications to the Materials and you retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials. Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarise, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorised use of the Site.
2. Geographic location
If you, as a User, purchase Materials from this Site or Progressive Equine Partnerships while outside of Canada, you may not use or access the materials while in Canada.
3. User Warranty
As a User you warrant that you are not an agent or employee of any other test preparation company or equestrian education provider and the Site and Materials are solely for the purpose of increasing your own learning.
4. No Warranty
The Materials provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Progressive Equine Partnerships further does not warrant the accuracy and completeness of the Materials at this Site. Progressive Equine Partnerships may make changes to the Materials at this Site, or to the services and prices described in them, at any time without notice. The Materials at this Site may be out of date, and Progressive Equine Partnerships makes no commitment to update the Materials at this Site.
5. Limitation of Liability
In no event will Progressive Equine Partnerships its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever (including, without limitation, those resulting from lower test scores, interruption of services or inaccurate information) arising out of the use, inability to use, or the results of the use of this Site, any websites liked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.
